In recent years, South African courts have increasingly addressed matters relating to delictual liability, particularly in cases involving state liability, most notably in instances of medical negligence and wrongful arrest.

There has also been a notable rise in claims concerning harm caused by domestic animals, the vicarious liability of the state and other entities for the wrongful conduct of their employees, and delictual liability arising from contractual clauses that unfairly or unreasonably seek to exclude liability.

Delictual liability constitutes a significant component of private law, particularly within the law of obligations, as it governs civil liability for harm or damage resulting from wrongful and culpable conduct. At its core, the law of delict protects individual rights and interests from unlawful infringement. Given the evolving legal landscape, it is essential for legal practitioners to stay abreast of recent developments shaping this area of law.

Presenter
Professor Raheel Ahmed is a faculty member in the Department of Private Law at the University of South Africa. She is also an admitted attorney, notary, and conveyancer. Prof Ahmed has extensive experience in teaching the law of delict, the law of damages, and third-party compensation law at the University of South Africa. Additionally, she serves as an Education, Training and Development (ETD) practitioner for the LSSA/LEAD, where she instructs candidate legal practitioners in personal injury claims. Professor Ahmed has published widely in the areas of delict and third-party compensation law.
