About this online course

This course will provide an in-depth review of dispute avoidance and resolution mechanisms under each of the standard form engineering and construction contracts primarily used within the South African market – FIDIC, NEC and JBCC.
The course will provide a detailed review of the relevant provisions regulating dispute avoidance and dispute resolution mechanisms under the different suites of standard form engineering and construction contracts.  It will also explore the differences between each of these contracts to provide a better understanding of how to manage claims and disputes under these contracts appropriately.

The course will provide an in-depth look at key provisions related to claim processes and time-bars to enable the participant to understand how to avoid and manage disputes.

This course include 

  • A look at the relevant provisions regulating claims by the employer and the contractor, including time-barring provisions.
  • Looking at the relevant provisions related to determining and certifying claims.
  • Understanding the South African law on time-barring.
  • Understanding how to calculate additional time and costs to be claimed or determined.
  • A deeper look into how to draft notices and formal requirements under the relevant contracts.
  • Understanding the requirements for document management for purposes of determinations and disputes.
  • An in-depth look into the different claim events that are the main causes of disputes within the South African market and how these could be avoided.
  • Forms of alternative dispute resolution and deciding which mechanisms to include in your contract.
  • Understanding how to engage during dispute avoidance.
  • Understanding how to effectively manage disagreements, disputes, and dispute resolution processes.
  • An introduction into Expert Determination.

Presenters:
Lize-Meré Ludick 
Lize-Meré Ludick is a partner at Bowmans in Johannesburg. She leads a team of specialised construction lawyers with expertise in commercial and litigious matters related to infrastructure and construction projects. Her practice focuses on contentious construction matters arising from standard form construction contracts, including advice on dispute avoidance strategies. She also advises various clients on renewable energy projects, including the South African Government’s Renewable Energy Independent Power Producer Procurement Programme, and other public-private partnership agreements. She is a qualified mediator, an Associate of the Association of Arbitrators, and holds memberships with the International Chamber of Commerce’s Young Arbitration and ADR Forum, the Society of Construction Law, the Construction Adjudication Association of South Africa, the Chartered Institute of Arbitrators, and the International Bar Association.

Sethu Khumalo
Sethu Khumalo is a Senior Associate in our  Johannesburg office at Bowmans in Johannesburg and a member of their Construction Law Team.
Mr Khumalo has both local and international experience having practiced as an associate at Allen & Overy and Cliffe Dekker Hofmeyr, before joining Bowmans in January 2024. His primary practice areas include both non-contentious and contentious construction matters related to standard form construction contracts such as NEC, FIDIC, GCC and JBCC as well as EPC contracts.
In addition to the above, he has experience in insurance related disputes and has acted for numerous insurers and/or brokers in this regard.
Mr Khumalo is also a member of the inaugural Young AFSA committee, which strives to promote the interest of young practitioners within the arbitration space.
