Part B: In-Depth Analysis of Standard Form Engineering and Construction Contracts (Online Course)
4 and 5 August 2025 | 12:00 – 16:30
Gaining in-depth knowledge on standard form construction contracts: FIDIC, NEC and JBCC

About this online course

This webinar will provide an in-depth review of standard form engineering and construction contracts, focusing on key provisions in FIDIC, NEC and JBCC, including the similarities between the contracts and the differences in managing these contracts.

The course will also introduce participants to bespoke EPC, EPCM and O&M contracts used mainly in the renewable energy sector.
The course will start with a detailed look into the different suites  of standard form engineering and construction contracts, and explore the differences between each of these contracts to provide a better understanding of how to choose the most appropriate contract for a particular project. These contracts are often made up of various clauses and annexures, some of which can be incredibly complex; the webinar will cover the basic structures and key risk regimes of each of these contracts to give the participant a better understanding of the interplay between the various contract documents.

The aim of this session  is to provide a good understanding of how these contracts are made up and how they function.

This course will include:

  • Understanding typical contracts used in the renewable energy and construction sectors.
  • A detailed explanation of risk allocation and pricing regimes under the different standard form contracts for purposes of identifying an appropriate contract for a particular project.
  • Looking at how to amend the standard form contracts, including looking at the project specific details to be included and the key annexes to be negotiated and included.
  • A high-level overview on claims processes and determination regimes.
  • Understanding the principle of timeous notices and time-barring.
  • Looking into the changes in clauses between the 1999 FIDIC and 2017 FIDIC; likewise, the changes in clauses between the NEC3 and NEC4.
  • Detailed understanding of risk allocation, with a particular focus on South African market related risks.
  • The Employer’s Agents authority, duties and obligations.
  • Identifying key provisions to understand for proper contracts management.
