The constitutional imperative of fair labour practice underpins every employment relationship. Employers have the onerous task of adroitly balancing the maintenance of discipline and the rights of employees. Conversely, employees, while protected by certain rights, need to abide by the rules of the employer. Course content Discussion on the immutable principle of fairness which underpins the relationship between an employer and an employee. The disavowal of fairness can have serious consequences. Distinguishing between misconduct and incapacity. Misconduct is a breach of a workplace rule that entails discipline while incapacity relates to a disability or inability and is followed by counselling. Automatically unfair dismissals. The law will consider the conduct of an employer in certain circumstances to be automatically unfair, for example, discrimination. Dispute path: From dismissal to the CCMA and Labour Court the LRA prescribes the path that an employee must follow in disputing a dismissal. Presenter Saleem Seedat is an advocate of the High Court and has acted as a judge in the High Court and the Labour Court, who specialises in labour law, labour relations, alternative dispute resolution, and the law of contract. He is an accredited CCMA trainer and also lectured on industrial relations at the Wits Business School, and on labour law. He also is a former part-time senior commissioner of the Commission for Conciliation, Mediation and Arbitration (CCMA). |
