Note: Programme 1 is designed for legal practitioners and programme 2 mainly for support staff in an insolvency environment and/ or practice. About this course Programme 1: The Advanced Programme in Insolvency Litigation and Administration Practice is designed to facilitate your further training and development as a legal practitioner in the field of insolvency litigation and administration or, to provide you with the tools to specialise in this exciting field of practice. The course covers topics such as sequestration and liquidation applications, procedures for business rescue, statutory compromises, as well as intervening applications. You will also become familiar with the impact of the Companies Act 71 of 2008 on insolvency law and business rescue practice. Apart from its course leader, Professor André Boraine, a specialist in the field, the lectures are presented by acknowledged subject specialists in the field, including practising advocates and attorneys. Programme 2: Insolvent Estate Practice. This course is designed to provide support staff in an insolvency environment with the required knowledge to incorporate effectively. Both programmes are presented under the auspices of LEAD/LSSA in conjunction with the University of Pretoria (UP). It is presented through distance learning supported by online tutoring. Delegates should therefore be able to connect to e-online platforms. |
Course content Programme 1: The Advanced Programme in Insolvency Litigation and Administration Practice. Sequestration and liquidation applications; Procedures for business rescue; Statutory compromises; Intervening applications; Appeals and reviews; Rescinding sequestration and liquidation orders; Tracing and Recovery of estate assets; Obtaining warrants in terms of Section 69 of the Insolvency Act; Litigation regarding Unexecuted contracts and Voidable dispositions; Rehabilitation applications; The impact of the Constitution on Insolvency Law; Impact of the Companies Act of 2008 on Insolvency Law and practice, and business rescue; Relevant aspects of Insolvency administration, like: Rules regarding the application of the proceeds of the free residue; The proof of claims; Insolvency interrogations; Compositions; Basic procedures relating to the distribution of proceeds of realised assets and basics of drafting and lodging of liquidation and distribution accounts; The payment and collection of contributions by creditors; The Review procedures of decisions made by the Master of the High Court; and Cross-border insolvency procedures. Programme 2: Insolvent Estate Practice. This programme covers largely the same content as course 1 but it does not include the law and practice of insolvency litigation as such. (This programme also provides for people without a formal law qualification.) Entry requirements Programme 1: The Advanced Programme in Insolvency Litigation and Administration Practice. Course Prospective delegates should at least have a Bachelors degree in law as the programme will be presented on a postgraduate level and is designed for legal practitioners wishing to practice in the field of Insolvency Law. Programme 2: Insolvent Estate Practice. Preferably any tertiary qualification but post-matric practical experience in the field of commerce or in a legal environment will be considered for enrolment purposes. Course leader |
