About the Engineering and Construction Contract Programme
This online program consists of three independent, two-day courses (Parts A, B, and C) that can be completed in any order. While you may attend individual sessions based on your specific needs, completing all three is recommended for a comprehensive understanding of Engineering & Construction contracts. Certification is awarded upon completion of each individual course.

About this course
This course will provide a detailed review of the relevant claims provisions and processes, as well as time barring provisions under each of the standard form engineering and construction contracts primarily used within the South African market – FIDIC (1999 and 2017/21), NEC (3 and 4) and JBCC (2018 and 2024).
It will also provide an in-depth analysis of dispute avoidance and dispute resolution mechanisms under these contracts.
The course will focus on the differences between each of these contracts in the context of claims and disputes to provide a better understanding of how to manage claims and disputes under each of these contracts appropriately and how to utilise the relevant dispute avoidance mechanisms effectively.
This course will include:
- A look at the relevant provisions regulating claims processes by the employer and the contractor, including time-barring provisions.
- Looking at the relevant provisions related to determining and certifying claims.
- Understanding the South African law on time-barring.
- Understanding how to calculate additional time and costs to be claimed or determined.
- A deeper look into how to draft notices and formal requirements under the relevant contracts.
- Understanding the requirements for document management for purposes of determinations and disputes.
- An in-depth look into the different claim events that are the main causes of disputes within the South African market and how these could be avoided.
- Forms of alternative dispute resolution and deciding which mechanisms to include in your contract.
- Understanding how to engage during dispute avoidance.
- Understanding how to effectively manage disagreements, and dispute resolution processes.
- An introduction into Expert Determination.
Presenter
Lize-Meré Ludick
Lize-Meré Ludick is a partner at Bowmans in Johannesburg. She leads a team of specialised construction lawyers with expertise in commercial and litigious matters related to infrastructure and construction projects. Her practice focuses on contentious construction matters arising from standard form construction contracts, including advice on dispute avoidance strategies.
She also advises various clients on renewable energy projects, including the South African Government’s Renewable Energy Independent Power Producer Procurement Programme, and other public-private partnership agreements. She is a qualified mediator, an Associate of the Association of Arbitrators, and holds memberships with the International Chamber of Commerce’s Young Arbitration and ADR Forum, the Society of Construction Law, the Construction Adjudication Association of South Africa, the Chartered Institute of Arbitrators, and the International Bar Association.

How to register
Kindly note that registrations are done online. For certification purposes, participants should register individually, using their own email address. This will enable the system to generate a unique username and password for each person.
